Hi

I am non-residient alient having Nationality Indian and for 2005 my visa status was F1 and then OPT.

I bought a Honda civic hybrid so I have question whether I can have a tax deduction on it. I have read following links and I am confuse..

http://www.fueleconomy.gov/feg/tax_hybrid_old.shtml

In this link it is mention that Government agencies, tax exempt organizations, and foreign entities are not eligible.

http://www.irs.gov/publications/p515/ar02.html#d0e962

In this link it is mention that A foreign person includes a nonresident alien individual, foreign corporation, foreign partnership, foreign trust, a foreign estate, and any other person that is not a U.S. person.

Can you specify whether non-residient alien is eligible or not eligible for clean fuel tax deduction ?

Thanks in advance

Turin:

In my opinion, you do not qualify for the Clean Fuel vehicle deduction.

Sorry!

Dear ATE,

Don't want to sound stupid, but I really do not understand legal terms, so here is my question: How about a resident alien (I have been in US on H1B all through last year -2005) for clean fuel vehicle deduction? Thanks!

Yes, a resident alien can claim the clean fuel deduction.
