View Full Version : How do I evict a family member that is living in my apartment

I am asking for my nephew who is having problems with his mother who lives in his apartment with him, his fiancé and their 1 year old daughter. He lives in Linden, NJ. He told his mom when they moved in that if she reverted back to using drugs (she was a recovering addict) that she would have to move out. Now that he has discovered she is, in fact, back on the drugs he has asked her to leave. She is refusing to move out and says he will have to evict her. He has called police who say that they cannot make her leave. The courts are not much more help as they told him since he is not the landlord he cannot evict her.

What can he do at this point to get her out of his house?

Contact his landlord, offer to pay the cost, and ask the landlord to evict the mother.

That is really his only option, other than to move out himself, leave her there, and let the landlord evict her, and probably sue him for breaking the lease.

Actually he should be able to evict her, she is basically a sub renter under him. And if flied in court ( stop asking clerks what they thing) once before the judge, all he has o prove is he allowed her to move in, and she is responsible to him for living there.

But yes, the regular landlord can do it for him too.
