I want to file the proper paperwork to get full custody of my 11 year old son. His biological father has not seen my son or supported him in approximately 8 years. He has an extensive criminal record and several warrants for his arrest. Once a year or so he calls my mother's house with death threats. I have called the police on several occasions. However, never really continued to pursue it legally through the courts. I might be moving out of state and I want to make sure I take care of this before I do so. I have always had a stable job and have always provided for my son. Will it be difficult to get full custody? I can not afford an attorney. I live in San Diego California. Any feedback would be greatly appreciated.

What is the current legal custody?

It souns like you have legal custody, and sounds like you already have phsyical custody. So what do you really what, to take all rights away from the father?? If he has been in prison for a felony in some states this is grounds to have the fathers rights taken away. You issue is that it is just not filing a paper, you will have to prove how the father is a threat and without an attorney this is almost impossible. You will need to see if there is a legal aid socieity that can help you.
