View Full Version : Wanting to place a lien on a property

We are a small condominium homeowner's association. One of our owners has not paid his monthly dues, so we are needing to put a lien on his property. Is this something that we can do ourselves - and if so how do I do it? OR - do we need to obtain a lwayer?

Without knowing what rights the tenant may have signed away when they joined the HA, I would say normally, you would have to take them to court, and win a judgment against them, before any liens could be attached to the property.

If the condo association documents give you the right to file a lien for dues (and most of them do) then it would be a good idea to use an attorney the first time. They will prepare the necessary form and file it. Then you can use that form in the future to prepare the liens on your own and file them when necessary.

(Check the condo documents carefully. Very often they will allow you to add the cost of the legal fees to the amount of the lien.)

Thanks so much for your help! Yes - the documents do state we can place a lien if a tenant hasn't paid their dues. I will contact a lawyer first and go from there.
