Hello,

I have been trying to pay my rent but a lot of things came up and I am late on 5/1/08 rent. I was trying to get a loan, but have been unable to do so. I am moving out on Sun, 6/1/08, as the tenant where I am moving cannot move until Sat 5/31/08. My landlord had the Sheriff's department serve me a 1 day notice today, but it is dated yesterday. I told him I was moving Sunday and he got very rude with me and said too bad if they put your things out. I have been there 10 almost 11 months.

Is it true that they can actually take you out of your apartment and move your things out?

If the notice was an eviction notice, and not a notice to quit, then it is possible that the eviction could happen anytime after the notice expires.

They do actually take all your belongings out, and set them on the curb.

If you refuse to leave, you will be arrested, or removed by force.

Yes, if that was a actual eviction notice, yes, the court will send a officer out, he will stand there while the landlord or someone hired by him moves all of your belongings to the curb. The officer will stand there and make sure you do not stop them, and if you cause any touble, they will arrest you.

The officer will normally keep anyone from bothering your belongings as well as he can, until it is all out of the house, but the minute he leaves, anyone can basically come take what they want.

Here in Atlanta, people line up on the other side of the road, and when the officer tells them they all run for the pile to grab what they want.
