I have been dating my boyfriend for 1 year now, he is mexican but he is not here legal. Now we want to get marry and be a family with my kids that love him like me a lot. Now what steps should I take without having immigration taking him back to mexico? We are ready for commitment because we are in love not because of papers or visa he has always tellme that because he has never been married and lot of his past relations has offer him to marry them and they are usa citizens, but he refused due that they are not the person he want to marry for the rest of his life. I need to know if someone can help me and guide me through this process without no one been hurt.

Of course getting married is no automatic road to citizenship and he may be requried to return to Mexico and apply. So are you so in love with him that you can return to mexico with him if that is the case?

But to get married, you go down to the court house and get a marriage license and get married.

This depends upon whether he entered the U.S. legally with a valid visa/visa waiver program or not.

If he entered illegally and no one ever filed an immigration petition for him in the past, you may get married in the U.S. but he'll eventually need to go back to his home country for his green card interview in conjunction with a waiver application for his unlawful presence in the U.S.

Please consult an experienced immigration attorney. You'll definitely need one.

I am also in the same perdicument as you are.. My husband is also from Mexico. I went and spoke to an Attorney who told me that yes my husband will have to go back to Mexico eventually but it will just be for the interview. My Attorney said that because we are married I can apply for residency on his behalf and while for the petition to get approved takes up to 2 years he can stay in this country until the appt at the consulate in Mexico. Once we get to Mexico they approve the petition that same day and he comes back on a plane with me. Just food for thought. Also I suggest if you have any questions Google information on illegal immigrants and waivers that are available. Or even go to the US Customes website it was really helpful to me.

If you just get married he won't have to go back to mexico, the only way he will have to go back is if you want to help him get his papers by your lawer filing a 130 form I believe... I know this because my brother is in the same position
