View Full Version : How can I get my x wife to have a DNA test for our daughter?

I am serving in the military overseas and my x wife is asking me to give up my parental rights so her husband can adopt her. She has made it impossible for me to see and be with my daughter. My daughter is now 16 and I have seen maybe 10 times. I have three other children form my current wife and every time I try to get to see my daughter she either says she is afraid to let her fly or we are going on vacation during that time etc etc.. Always an excuse. She expects me to go to her house and pick her up and then travel back to drop her off. I have had my doubts to whether she is my child. The reason I say this is because, when I left to go to Germany she did not want to go, so we separated. 5 months later she called me to tell me our house had been broken into and I had to return to fill out the insurance claims forms. 6 months after I got back to Germany and started to date she claims she got pregnant and the doctor told her she was going to have the baby at 8 months. Sure enough she had a 8 month baby. All I want to know is if she is mine. I have been paying child support for 16+ years and deserve to know but she will not do the test. Is there a way I can ask the court to make her take the DNA test?

Depends on the state, really, some states after a number of years you can not challenge the paternity of the father listed on the birth certificate esp if they were married. So the DNA test was something you should have asked for 15 years ago.

But you can hire an attorney are see if the court will order it. Or to be honest, you have not taken her back to court to fight for visit rights, the new husband has been the father to the girl, I seldon say this, but this is one of those, sign over your rights and let it go.
