Hello my name is Charlotte. My son is 22 years old, not working, not going to school, and is using drugs. His behavior has prompted me to try the eviction process. We live in the state of California, and he has no rental agreement with me. I rent the apartment that I am trying to have evicted out of, so I am not sure if the eviction process is the same in my case. I would really appreciate some advice on the proper notices to give prior to starting the eviction. I do not want to do this to him, but he refuses to leave, and he keeps calling the police, and they always tell me that I have to let him back in. I would also like to know if I can be arrested for not allowing him back in the house, and just pay him if he wants to sue me. He is driving me nuts, please help. Thanks.

I could understand you having to take him back in if he was underage and still dependent on you, but he is an adult, so subject to a proper eviction. The website below is regarding eviction with the proper forms you can download.
