I wouldn't be too concerned with him being arrested as much as how he can afford the baby. Because they are so close in age I don't think he will be charged with anything but part of that depends on her parents. He will still be responsible for paying for the child. The girlfriend can go to court right after the baby is born and get an order for support (not that she will if they are still together).

Your son would not be in any legal trouble as he is also a minor. He would now be considered an emancipated minor which he would definitely have to be responsible for the baby.
