View Full Version : How do I go about getting my son's last name changed?

I live in Texas and was wanting to get my son's last name changed to mine. On his birth certificate he has no father, his mother, now my wife is regretting not giving him my last name. How do I go about getting his last name changed, both the mother (my wife) and father want it changed desperately, as he has in now 2 years old. A little issue that my complicate thing's is his last name is hers from a previous marriage... Any help would be greatly appreciated. Thanks, and God bless to all.

In my area it is probate court. 1,You fill out the paper work(ours can be printed online and filled out) 2,you run an add the court paper or paper of your choice for 30 days. 3. You will be given a court date and the judge will determine if there is a just reason to change it. In m are the cost is 100 dollars, plus the paper advertisement.

To be sure call your local courthouse or if they have a court index you can get the info from there. As long as her previous husbands name is not on the birth certificate I can't see how that would be a problem.
