View Full Version : Am I win or not ? Against landlord trial

My landlord sue to me for non-payment case at civil court, housing part in Queens, NY.
I fighted him for suffering his harassments for 6 years.
He hired a lawyer and I was self represented in the trial.
I got the judge's decision after 5days from the trial (see attached file).
I am confusing this decision. Court Clark told "I am lost".
But the paper not tell any order to me. Also the landlord was granted $0.00 in money judgement.
Which side won ? Which side pay $12500.00 ?
What can I do if I was won, or I was lost ?

I'd say, from the way I am reading it, Sachiko owes the 12500.

I just don't trust "enclosures." Sorry. Can you post the final decision? Or call the Clerk and ask.

The relevant portion states:

Decision and judgement is rendered based on a decision made after trial as follows:

Judgment is granted in favor of Dackow, Ramon and against Watanabe, Sachiko

A counterclaim is granted in favor of the respondent in the amount of 0.00 (which if not being entered separately is offset and reflected in the total amount due, listed below)

A money judgement is hereby granted, along with costs and disbursements in the amount of 0.00 in favor of Dackow and against Watanabe for a total amount of $12500.

I think it's the second "0.00" that is confusing the OP.

the way I read it is that judgement was awarded to the Petitioner. A counter claim was granted to the respondenat with no monetary value. So, after deducting the value of the counterclaim, the Respondent still owes $12500.

What I suspect happened here, is the judge agreed the respondent had been harassed but that it wasn't sufficient justification for withholding rent. I hope you were putting the rent in an escrow account pending the results of the litigation.
