I have a family member who accused me of violating HIPPA at our local hospital, which on my part after a full investigation the findings were found un true.
I want to know do you think I would have a case for slander or defamation of characters to sue them? She jeopardized the creditability of the job I have to perform on a day to day basis. Any help in this matter would be appreciated.
Thanks
MK

An investigation was done and you were exonerated. Therefore you did not suffer any financial loss. While you can sue and will probably win, unless you suffered some fianncial loss, it will cost you more to sue then you can gain. So I don't see the advanatage in a suit. I would suggest consulting with an attorney, but I believe they will tell you the same thing.

If you had legal costs during the investigation, you may sue for those costs of course, But if someone has belief something happened they are free to report it. If you read here about HIPPA you will find even among the "experts" often we don't always agree is something is or is not a violation, and among non professionals most assume many things are violations that are not. I would guess ( big guess) that there are dozens of violations reported every day that is not a real violation, but only reported because of peoples misunderstanding of the law.
