My sons, ages 14 & 12, want to change their placement from their mother's home to mine. Their mother is being uncooperative and doesn't believe they actually want to do it - she believes I have manipulated them. Our homes are very different - she lives way out in the country and there are no other kids with which to play. The boys have said they don't really feel like a family in her home. I live in a large development that has a lot of other kids that mine have befriended. I have remarried (so has their mother) and have a 5 year old daughter.
Their mother moved away from our community 7 years ago - about an hour away. I have never missed a visitation nor a support payment. They have never missed an activity (baseball, soccer, birthday parties) because they were with me - I've always taken them. I also provide all the transportation to and from my home.
My question is: Will the court system be compelled to allow the change in placement based solely on the desire of my children?
