My landlord recently tried to evicted me for not moving out with notice, however, the case was dismissed because he didn't give me proper notice. After court a lawyer advised me that I should sue him for back rent for not having a rental license w/in the first five months of me leasing the property. In Minnesota I know that you must have a rental license to rent out your property what I'm not sure of is if I'm able to sue him for back rent and a deposit that wasn't returned.

And you don't trust your lawyer's advice because?

Well, when I went to get the paper work to fill out to sue I was told that these types of cases usually don't win.

Who said that? The Court Clerk? Amazing and out of line if he/she did.

Yes, it was one of the court clerks and on the way out one of the other clerks told me to make sure I file anyway. I just didn't want to waste my time if that was really the issue.

Perhaps they don't want to have to work - ?
No slam on Court Clerks but I've seen them tell people not to bother filing in Small Claims Court more than once - and then the person filed and won. I have no idea...
