Hi

I obtained a green card through marriage, my spouse being a U.S citizen. However during my conditional permanent residence my husband travelled abroad for a temporary job and I followed him after applying for a travel document. I spent 8 months outside the U.S. I am now an unconditional permanent resident and residing in the U.S.

My question is does the period of my stay outside the U.S with a travel document =8 months count towards my 3 years residency requirement inside the U.S for naturalization purposes? Or am I only eligible for the duration I actually spent here after we moved back?

Thank you

SL

To be eligible for naturalization based on marriage to US citizen, you must physically be in US at least 18 months from the date you first obtained conditional green card, and must remain married.

You must be in US physically 18 months.. at least...
So you cannot count the 8 months outside US. Period.
