My son-in-law is currently on Workmans comp. He is considering leaving the company altogether and going back to school instead. If he does not return to his current employer, will he have to pay back any of the money he has already collected?

He should not have to return the money as he was using this money for a legitimate reason - he was injured. If he does not return to his current employer and goes back to school he needs to tell workman's comp what he is doing the second he goes back to school. He may or may not be able to continue to collect any money from workman's comp. The final decision will be workman's comp.

As long as the doctor has not approved him to return to work, and as long as the company did not offer him light duty work, he can keep all of the money he got up and to the point he has decided not to return to work and go to school. At that point he will need to contract the worker comp insurance company and inform them, He may still collect if the doctor says he can not return still, but again they may not
