I currently share custody with my son's mother. I am married and have another child named steven. I have a stable home environment and have had for the past eight years. When he was at her house last he was making A's-D's on his actual report card. The D's are the problem. He is an honor roll student at my home whenever he is with me. He is unsupervised there at night and sends himself to school a lot of mornings. He is 10. He also is does very well in sports at my house and makes allstars for some sport before having to return with her. What are the chances that the judge will let him stay at my home for the school year so that he can get a proper education and supervision. I am going to court because I want what is best for my son.:)

If you can document these issues you may have a good case. There is no predicting what a judge will rule, but you appear to have a compelling argument.

My guess as to your chances: 51%. I am curious as to how and why he is unsupervised at night, and has to send himself to school a lot of mornings. Two concerns: 1) Does he want to move to your home on a more regular basis? It may be possible for the judge to interview your son, in chambers, as they say, away from the attorneys and you and mom. 2) Is she going to dispute the custody issue to avoid paying you child support?
