View Full Version : What do I do the home I rent is being foreclosed?

About 7 months ago my children , my husband and myself moved in to an apartment on April 23rd 2008 our landlord told us we have about 4 weeks until we have to be out because he no longer owns the house it now belongs to the bank. He and his girlfriend are harassing us for the rent monet so the questions I have are, legally do we have to pay the rent being that we only have about four weeks? And is there anything we can do to find out an exact date we have to be out? Keep in mind that before the 23rd we had no knowledge of the forecloure we were completely unprepared for all of this.

Well a couple of issues, if he no longer owns the property, he has no right to ask you to leave, come by, or even come onto the property that the bank owns.

If it is only in the process of foreclosure and he still owns it, that is different.

So if he has told you he no longer owns it, you need to find the current owner if that is the bank or whoever and see what they want to do about you paying rent

Now also are you on a month to month rental, or do you have a lease.
If you are on a month to month rental, the landlord can give you notice to move.

If you have a lease, it is valid until the time the foreclosure happens.

Now if you are staying there, the rent is due and payable for the time you are in the home, so if you owe rent, it is supposed to be paid.
