View Full Version : Credit Card Debt & Garnishing bank accounts

I have been served with a court appearance for credit card debt in the amount of 7K from Discover Card. I was diagnosed with lung cancer in July 2006 and had a large portion of my left lung removed. I did not work for nine months and had no income for that nine months. I was forced to default on my Discover Credit Card account. To make a long story short, Discover Card is suing me for the debt. What are my options? I have a limited income now, but not what Discover is asking for. Can by bank account be frozen and or garnished? I am at a loss as to what to do.

You will have to appear and attempt to defend yourself against the suit.
If you have any way of working out a payment arrangement with them before you go to court, that should be your first priority.
If they obtain the judgment, they can levy your bank accounts and they can place liens on your property, just for starters.
I understand your ability to pay has been hindered, unfortunately they won't care much about that, they just want the money you owe them.

Hopefully the court will have mercy on you due to your medical condition. I don't know if you could transfer all of your assets (before the hearing if no leins have been levied yet) to a son or daughter or not, but it might be an avenue to consider. Might consult with an attorney on that.
