View Full Version : Boyfriend kicked me out, I want to know my legal rights.

I was dating a guy for 5 years. We moved in together about a year and a half ago. We lived in a house that he bought about 2 years ago so we were paying mortgage therefore there is no lease. I moved in, and I was helping pay the bill but my name is not on any of the bills or anything. There was no written agreement of any kind. I mean I assumed one day we would get married and it would be our house anyway. He kicked me out and tried to give me about 48 hours or he would call the police. I have no family or no place to go so it's not that easy to get out in that short of a period. I would like to know exactly what law it is that tells you the specific rights that you have. Also, do I get a 30 day notice and then he would have to take me to court to get a notice to evict and then I have 3 days or something like that? I'm not sure and what type of law this is and where can I look?

A lot may depend on where you live, since you are a tenant in the home, even if you had utilities in your name, you would still be a tenant. Each state has its own rules, but normally he will have to give you notice, this may range from 15 to 60 days, but most likely it will be 30 days, since there is not a non payment issue.

You really want to be out before the court thing, but then you may come back and find yourself locked out and can't get in, and then you have to take him to court and sue him all while living in your car I guess
