View Full Version : Unifund on credit report, what should I expect next?

Hi everyone I really need some advice. Today I pulled a copy of my credit file and saw Unifund with a 22,000.00 negative account. Are they in the process of suing me? What can I do, should I call them? I disputed the charge on my credit report but Im scared that the sherriff will come and serve me with court papers!! Should I call them and deny the debt? Please any suggestions are apprieciated.

Just because they put someone on your credit report does not mean they are going to sue, it means they say you owe them the money.
And debts are not going away by ignoring them, so have they been sending you bills, notices.
And if you don't legally owe them any money, going to court will be the best thing you can do.

It could also be a mistake. I pulled my credit report and had an unpaid hospital bill from 5 years ago - I've never been at that hospital, it is out of my area, it was a mistake. They investigated and corrected the report.
Makes no sense because in theory creditors use SS numbers but...

I can't remember if I had this account or not it was origanally opened in 2003. This is the first thing I have seen from them. I have read up on Unifund and they seem like snakes, I don't want them to sue me without my knowledge, What should I do next? Call them or what? I don't think this my debt but I did have a charged off account years ago. What should I do call them and tell them its not mine, ignore, or hire a lawyer?

People sue other people all the time without informing them first - very often your first clue is when you get served with papers. Then you go to the hearing with your defense and the Judge decides.
They aren't snakes if you actually owe the money, the claim is within Statute and you haven't paid a debt. You may not be happy with them but they are trying to collect a debt.
The fact that it was charged off by the original creditor doesn't mean someone else hasn't purchased it and isn't trying to collect it now.

This may not be my debt, should I call them and ask them to send me proof of debt owed, ignore and wait on experian to delete off file, or call a lawyer? They are snakes!! When someone has a 790 credit score you don't just put something like that on it without notice! I don't know if this is my debt, what should I do.
CAN ANYONE GIVE ME REAL ADVISE? MABYE SOMEONE THAT HAS HAD THIS HAPPEN BEFORE!! PLEASE any helpful ideas?? What can happen to me?

You have been given pretty darn good advise here, you just seem to not be reading it?
Is it your debt? That should be a yes or no question.
You won't be sued without knowing about it so don't worry, you will be notified.
If you owe, and get sued, you will have problems.
If it is not your debt, and you get sued, you have nothing to worry about.
That pretty well sums up your situation in the shortest form.

Can anyone please give a knowledge based answer. If I want a lecture I will call my mother can anyone give me a real answer to my question. Has anyone been in this situation that can offer a next move suggestion.

Yes, I would DEFINITELY call your mother. She presumably raised you and has some understanding of what you want to hear. Perhaps she has more legal experience than the people who have answered you here - or at least maybe she'll tell you whatever it is you want to hear.
I offered you the next move(s). You obviously didn't like any of the info posted but you have been offered advice on the next move(s).
I will also suggest that you not mention specific firm/company names and call them "snakes" repeatedly - I would suggest you read the slander/defamation info on this board. It has, could and might happen to you.

Anyway - creditors don't call you and say, "Hey, we're going to sue you." They serve you with papers. This particular angry woman with no life runs a process service company and that's how it works.
So call them - I have already told you the fact that it was charged off doesn't mean that they can't try to collect it now.
Answering your questions (without offering any additional options) your choices are (1) Call them and say it's not yours - even though it might be yours and it was charged off. They won't take a phone denial. They'll sue you and possibly get a Judgment. (2) Ignore it , they'll sue you and possibly get a Judgment. (3) Hire a Lawyer - hopefully not an angry woman - in anticipation of getting sued. Don't know what kind of advice you'll get because you have no legal papers.

First, there are rules that you agree to when you join this site. You need to be more polite and try listening to the advice you have been given. Several of your posts have been removed because of your insulting people trying to help you. If you continue, you risk being banned.
Second, I find it hard to believe that you would not recall a debt of over $20K from only 4 years ago. You apparently had an account with them, but don't recall what happened to it. I don't know how you keep your finances, but I would have records of any debts I incurred.
But, you apparently did the right thing. You contacted the credit bureau and protested the entry. What happens when you do that is the credit bureau first investigates to make sure they entered the data correctly. It then sends a notice to the creditor asking them to verify the data. If the data cannot be verified, then the entry is removed. That it was removed only 4 days after your notifying them tells me that the error was on their part.
So you ask what do you do next. The answer is nothing. The only way the entry would have been removed is if they didn't have proof it was your debt. Since it was removed they do not have sufficient proof to take you to court. Again, because, it was removed so fast, I suspect it was simply a data entry error on Experian's part.
So you can relax now and just go on with your life, and maybe apologize to the people here who tried to help you.
