I has been L1B status with X company and visa valid till Oct 2009, I had file H1B of year 2009 with Y company. I know that I should not work on L1B from Oct 01 2008, If my application pick in random selection then I could not. I am thinking that, I will inform to my X Company about my H1B and ask them to transfer from Y company. If X Company is ready to transfer my H1B then its fine. If they say NO, they will cancel my L1B and they as me to go back to india. I don't want to give them this chance. So, I am planning that I will inform about H1B last week on September.


a) How many day's to process the cancel my L1B?

b) If X Company is ready to Transfer my H1B. How many days does it will take to process?

The best way is to have Y company file application with USCIS for your H-1B transfer.
You might be asked to submit the following documents:

* One or two latest pay stubs.
* Copy of your existing H1 approval.
* Passport copies.
* Copies of I-94 records.
* Copy of SSN.
* Latest Resume.
* Copy of existing valid visa.
* Copy of all your Diploma/Degrees.

Once they are submitted with the USCIS, it takes normally 3 to 8 weeks, or in some case a little more time. The time varies depending upon the location of employment.

Nothing to do with X company. Termination of contract can be made either by you or by your employer. The transfer is Y company's responsibility, not X.
