View Full Version : Tax exempt on OPT

HI,
I'm an F1 student from India.I'm working full time on my CPT and will be on my OPT from May 2008. I just realized that my employer is deducing SSN and medicare taxes from my paycheck. When I spoke to him saying that I don't have to pay SSN and medicare on my F1 status I came to know that he is not sure what I'm talking about . So I just wanted to know where can I find some information on this issue so that I could take the documentation to him. And my last question is, can I claim for these SSN and medicare taxes that where deduced so far when I file taxes next year ?

You can find the rules in IRS Publication 519. The form for claiming a refund is Form 843, assuming your employer does not refund the money to you directly. Both of these items are available on Internal Revenue Service (http://www.irs.gov). Use the search in upper right hand corner of the home page.

Everyone on F1/OPT is exempt for 5-years. Exempt means exempt form residency and when you are exempt from residency you don't pay FICA taxes.
