I have a son who will be 19 years old in June. He will be 20 years old when he graduates. He is getting ready to move away from home in with his Aunt this summer. My question is can I get the child support dropped, or will they have me pay my son or his Aunt the child support. I live in Indiana.

They should automatically drop it when he graduates unless it is stated in your child support orders to continue to a certain age. Child support is usually dropped by 18 or graduation unless they go to college then it can be continued.

From reading Indiana law it looks to me like support must be paid until age 21 (unless the child is emancipated - self supporting) and you would have to file a Petition to Modify based on changed circumstances to change (including paying to another party) or stop child support payments before age 21 (emancipation included).
Indiana Law is very complex - I never looked at it before and was rather surprised.

I think maybe I should get a lawyer to get this modified. I do not mind paying my son, but I do not think the court would allow the mother to still receive the child support if my son no longer lives with her.

You are right the money should go where ever your son goes so yes you need to modify it to go with him.

Depending on the laws of the state of Indiana and what your son's future plans are, I would think that a 20-year-old living with his aunt of his own accord would be considered emancipated, in which case you should be able to get the child support terminated.
