This was my original question my hisband was not arrested but he did have a trial and judge found him guilt gave him probation for 3 years he already did 1 year out of 3. but he said he could plea after probation since he had no prior record and no jail time at all. Can you please read and help me with these questions please.
Please help me with this situation. I have 2 questions first one is my husband has a 2nd degree assault felony with no prior record no jail time no arrest was made, he was put on probation for 3 years in 2006 supervised for a while and then unsupervised, he paid his restituition and all the fees with it. I just became a Us citizen he is 21 has been living in for more than 6 years. He already did 1 year for his probation. Can he apply for citizenship and how soon? Can they turn him down or depot him? Does he have to get it expunged first and how?
SECOND my mother was charged with theft for less than $500 she was arrested but served no further jail time. She was charged with misdemeanor and received probation for 11 months and 27 days she paid her restituition and her probation ended in January of 2008 she has been living in US for 6 years. She has no prior record. How soon can she apply and would her case be rejected? Does she have to get it expunged and how?
Please please help me

These are risky situations. Even if you have committed a minor crime, Immigration may deny your application.
I would suggest you consult experienced immigration attorney.
