Hello,

I have been in the US since 2003. 2003-2005 on an F1 visa, and now am on an H1b Visa.

On F1 (2003,2004) I filed 1040NR EZ, for 2005 and 2006 I filed a 1040EZ.

I have recently found out that I may be eligible to file under 1040NR EZ ( under the US INDIA tax treaty).

Am I eligible?

If so what are the documents I need to send along with the 1040NREZ.

If you did not complete more than 183 days on H1-B in 2007 and you are single, you can only file nonresident tax return Form 1040NR or 1040NR-EZ.

If 2006, you filed the wrong form. You filed resident tax return while on F1/OPT you are nonresident for 5-years. You may have to file amended tax return.

In 2008 you will file resident tax return.
