View Full Version : Do I need to file State Tax Return? I have 2 pages in W2 form.

Hi,

Lasst year I was in US for just 1 month and 2 days on H1B. My client office was in NY and I use to live in NJ. I received my W2 form which has 2 pages. It shows state tax for NY = 300$ and for NJ it is $1.04. My total earnings during this time was around $6000 (Gross). Do I need to file my Tax return for both NY and NJ or is it OK if I file only for NY because the witholding for NY are $300.

1. Yes, you will file NY tax return since you worked in NY.
2. You will also file NJ tax return since you lived in NJ. On the NJ tax return you will claim credit for taxes paid to NY.

But my gross salary was less than 10000 and NJ state tax web site says if a person has gros income more than $10000 then he should file State return. If it is not mandatory then I don't want to file for NJ. Please let me know if there are any legal issues involved. Last month I have come to US again and this time I am in MN.

If you lived in NJ for the requisite amount of time, you MAY qualify for a rebate for the rent you paid.

However, you MUST file a tax return to be eligible for the rebate.
