I'm on an l2 visa and arrived here in US last aug 2007. I'm not working and does not have an SSN or ITIN. My husband on L2 visa arrived here last feb2007. Here are my questions:

1. can my husband file for a tax under MFP ?
2. can he file tax exemptions for me and my daughter (4yrs old) even if we do not have ssn or ITIN? I read that he can submit our w7 application along with his tax return but I read also that I cannot apply for ITIN if I'm elegible to apply for ssn.

What are other options to maximize our tax exemptions ?

If your husband came in Feb 2007 on L1 visa, you can file joint return as residents. You will get standard deduction of $10,700 and exemptions for both of you and the kids.

You will complete forms W7 (application for ITIN) for yourself and children and attach with your tax return. You can also deduct moving expenses. Use form 3903.

If you feel you are eligible for SSN, then get SSN and then file your tax return.
