My husband is on an F-1 visa and I am on an H-1 visa. We are filing tax together and wanted to know which for we should use.

We consulted someone and he said we should use a resident form for federal taxes.

Yes, you can file resident return but if you did not complete SPT in 2007, then you will have to wait to file your return till you meet SPT in 2008.
