View Full Version : Resident or nonresident for tax purposes in J-1

Hi,
I am a J-1 scholar, single, since May 30, 2007 throughout the whole year 2007. According to the " substantial presence test" I qualify as a resident of US (216 days constant stay as work days).
I am exempt from any FICA tax withholding for the US-India income tax treaty, article 22.

Which form shall I use to file fed tax return. I want to qualify for the recent "economic stimulus plan by IRS". Nonresident aliens are not eligible for that plan. So, can you please suggest me how should I file my tax return to get the economic stimulus plan ?

On J1 you are exmpt from residency for 2 years (or more for students). You can only file nonresident tax return. You will also file form 8843.
