View Full Version : 2 week stay turned into 4 months, can I kick out

I live in Virginia. My husband and I own our home and my mother lives with me (rent and utility free).

On 4 January 2008 my sister showed up on my doorstep from Arizona. She said she had a couple of doctor appointments in the area and needed to stay with me for 2 weeks. We agreed to the 2 weeks. This was a lie she did not have any appointments lined up.

My husband and I have repeatedly asked her when is she leaving. She would normally say 2 weeks. The 2 weeks would pass and she’ll have some excuse about her not getting the money she was waiting for or the job she had lined up fell through. It’s been 4 months and we (husband and I) are ready for her to leave. Do I need to do a formal eviction or is a quit notice fine?

Also my sister is collecting food stamps. My mother signed a document confirming that my sister is staying with her thus allowing her to receive the food stamps.

Do I need to evict my mother in order to ensure my sister leaves?

I’ve never truly had a good relationship with my sister and she despises my husband and my husband’s family. She getting too comfortable, she’s beginning to express her hostile unsolicited opinions about me, my husband and family. I want to have her removed from my house. What do I need to do and what documents I should be reading as reference?

You should do a legal eviction notice (10 days) and if she does not leave then go to General District Court. Virginia Evictions (http://www.rentlaw.com/eviction/vaeviction.htm)
