Ok I am the Primary Giver of a 17month old Boy that is 4 days older then my own son and they both have the same dad. The mother of Daeren Has not called since the day before his first birthday and She called today 3-31-08. We had court hearing on June 5th 2007 for full Physical and Legal custody and she never showed up. We were granted everything she got Supervised Visitation 2times a week for 2 hours a day and she has never once seen him since we got Emergency temp custody of him!! She won't give her rights up to him and I feel so bad for the little boy. Today when she caled she tried saying we deny her of her rights to see her son!! How can we deny her if she never calls?? She says she calls all the time but She hasn't! I have it all documented in a notebook how many times her and her parents have called which has only 2 in a half pages full!! She stated I was not his mother that she is!! I feel like I need help she doesn't pay child support nothing... I want to adopt him but she won't let me is there anyway The state can force it appon her

Nope.

Since you DO have full custody, though, you can go after child support.

I wouldn't advocate ANY law that forces biological parents to give up their rights without extreme good cause--that's a nightmare waiting to happen for birthparents, many of whom were coerced into choosing adoption to begin with.

Make sure you have a lawyer--this is going to get messy, and probably really fast.

Many people, though, when forced to pay child support, willingly sign away their rights if you'll waive the back support as well.

I have contacted the social services for Child support and they said they can not make her pay since she is on General assistance and Has a dr excuse not to work!! It is not pretty...

Get a lawyer. Seriously.

There are ways to show she is an unfit mother, who doesn't take an interest in her child, but you will NEED a lawyer to pursue this.

I have a Lawyer We have proven she was unfit back in June! That is why we have him... She is physically and mentally unfit to care for a child...

What does your lawyer say about severing parental rights, then?

This is law that will vary from state to state, so your lawyer would be the best bet on what steps to take next.
