View Full Version : Will filing bankruptcy erase a judgement

Yesterday I got notice Capital one had placed a judgement on me and I had contacted an attorney about a month previous to discuss bankruptcy... I have approx 10k in credit card debt that is to be included in the filing... 5400.00 of that is this debt that now is a judgement... everything is going wrong, as we got notice from the IRS that we are being audited for 2006!

Bankruptcy will discharge the debt, but not a lien (judgment lien in this case). There is a process within the case by which the lien may be avoided, and that will depend on whether, and how much, equity you have in other property, and the exemption provided by your state. Review this carefully with your attorney.
