I am a 48 year old father who pays child support. I have not seen this child for 5 years, by the mothers choice. ( adopted child) She was arrested in her high school and is now sitting in jail awaiting her trial. I went to court last week but the judge ordered me to pay support as I have been. I was under the impression that once they were out of school OR out of their home, they could be emancipated. She has been sittng in jail since oct 31 2007. I DO NOT WANT her MOM to get this money... what are the laws? Help please...

No beingin jail is just being in jail unless someone posts her bond.

What you should have been doing is of course trying to get custody of the child to help raise her. Also, so for 5 years the mom did not want you to see the child, who cares?? What the mom wanted, you go to court and force visits, that is your right.

And this is far from emanicipated, as you found out. You are paying now for poor choices made over the last 5 years of not seeing your daughter,
** you adopted her so you are legally obligated which was also your choice. So now you no longer want that obligation when it is not working good, being a father does not work like that.

For one thing, she was arrested in school for selling drugs. She was arrested three times last year. I adoptd her to give her my name when her mother and I got married. She has called or stopped by three different work places and demended I be fired from my job. I have raised two kids. One is 30 and the other is 28. This adopted child is 18, sitting in jail and I have to pay support? To who... she won't get a dime of this money. This is why I am so upset...
