View Full Version : Statue of Limitations re: Cdn Soc. Assistance

Back in approx. 1991 I divorced and had to go on Social Services Family Benefits. My ex-husband was ordered to pay child support which he never paid for approx. 9years. I received my social assistance for approx. 2yrs? And then withdrew due to gaining employment. Now, 17yrs later, my exhusband is trying to get his support payments reduced or eliminated, (they garnished his pay in the last years). Due to the legal situation at hand, my lawyer received a letter from the municipality that I received social services from. They claim that now that I am receiving child support that I OWE them back all the monies they had paid to me while I was on social assistance 17yrs ago. My lawyer has never had a case like this and I don't know where to gain the information I need to fight this. Is this legal? Is there a statue of limitations? If I was receiving approx. $1000.00mnth from Soc. Svces and the court order for child support was approx. $500.00 are they asking for just the $500.00 back? I have no idea what is happening. I didn't know this was even legal for Soc Services to ask for repayment. I am currently on long term disability due to a several surgical procedures, and am only collecting min. mnthly payments. What should I do? Is this legal that a municipality for Soc Services can demand back payments because 17yrs later I am now receiving child support? Please help. Thank you,

I don't know why they would go after you when I have yet to see them go after anybody else that has been on it for years.
I know they used to put a lien on some people's houses until that was ruled against them.
They probably came up with the $500. Amount according to your current income. Are they saying they want $500. A month for xx amount of months?
