View Full Version : How can I evict a roommate too sick to work?

My roommate, no longer on the lease (we 3 guys live in a 3 bedroom house), has deteriorating health issues and cannot work. He has a bad heart and is on oxygen and everything he does is difficult for him. He literally stays in his room 24 hours a day, only coming out to cook (and leave the dishes) or use the bathroom, (which he never cleans). He doesn't lift a finger. I however, work at a home business with my other roommate, while this guy lies on his back and watches TV all day and all night. He occupies one of the bedrooms in the back, while I being the latest arrival must sleep on a cot in the living room.
He pays no rent or any utilities. I have been doing the legwork on getting him the paperwork for food stamps and he received his first installment. Now he hordes food in his room and makes dinner without inviting us to share his food. He's a Navy vet and I'm sure he can get the VA to get his butt into subsidized housing with general financial aid. That, with his food stamps should be enough for him, but I don't know this difficult process. I want him out. I live in New Mexico. Please help.

He should also be able to apply for social security disability but he would have to make an appointment to apply and get a report from his doctor.

Ok, who owns the property and who does he rent from?

If you are the "landlord" you can evictt him, If you all pay a separate landlord you will have to get the real landlord to do somehting,
What really matters is what legal rental agreement does he have, or did he have, who was it with.
