View Full Version : Dual-status alien on L1 visa

I am on L1B visa and arrived in US first time on Feb 2007. My wife and child arrived on Apr 2007 on L2 visa. We are living in US till date except 15 days period in Feb 2008. I have a SSN and my wife has received her SSN yesterday (without submitting EAD meaning based on marriage document). I am planning to file my tax return under “Married filing jointly” and my wife does not work. My company has bared my moving expense but I have bared my wife and child moving expenses. My questions are:
1. Am I a resident alien for the tax purpose?
2. I guess I have a dual-status but can be treated as resident if I elect to be treated as resident alien for 2007. If yes then can I submit ITIN for my child stating “Dependent of resident alien”.
3. Is my wife authorized to work since she does not have EAD authorization?
4. Will I get child tax credit for my child?
5. Am I eligible for 1500$ stimulus payments for 2007?
6. Can I declare moving expense if I do not itemized my form?
7. Should I select 1040A form?
8. I have received salary in INR for the month of Jan and part of Feb. Do I need to declare that in foreign income? Can I claim foreign tax credit?
9. Will I get exemption for dependent child and my wife?
10. I believe I will get 10700 std. Deduction and 13600 personal exemption is that right?
I would appreciate to help me to figure out above-mentioned questions. Thank you.

About 38 users visited the post but nobody replied. That was a strange anyway I finally consulted H&RBlock. Here are the answers of my questions:
1. Am I a resident alien for the tax purpose? YES
2. I guess I have a dual-status but can be treated as resident if I elect to be treated as resident alien for 2007. If yes then can I submit ITIN for my child stating “Dependent of resident alien”. ya I can be treated as resident for 2007 and I can select "Dependent of resident alien" in ITIN for my child.
3. Is my wife authorized to work since she does not have EAD authorization?She has received her SSN stating "For work only under DHS Authorization" so i guess she can work only after having valid EAD.
4. Will I get child tax credit for my child?YES
5. Am I eligible for 1500$ stimulus payments for 2007?YES
6. Can I declare moving expense if I do not itemized my form?
7. Should I select 1040A form?Form 1040
