Hi there,

I worked as OPT status in the period from December 2006 to July 2007 and H1B status in the period from October 2007 to now, and I am confused on how to file my tax. How do I file my tax in the two different status? Can I use e-filig tax one time for the two different status, or I need to do it separtently? What forms do I have to fill out? Also how do I return my SSN and Medicare tax in my OPT period?

You CANNOT efile, as you must file as a non-resident alien, filing either Form 1040NR or 1040NR-EZ.

To claim a refund for improperly-withheld Social Security and Medicare taxes, you need to file Form 843 along with several support documents and a memo from your employer stating that they cannot refund these taxes. See Page 49 of IRS Pub 519 for details.
