Hello All

I would be glad if someone can help me out with the respective forms required:

1. F-1 status from 01/01 - 01/04 2007
2. OPT status from 01/05 - 09/30 2007
3. H-1B from 10/01 - 12/26 2007
4. F-2 from 12/27-12/31

I am an Chinese Citizen & had entered the US in Jan 2005 on F1. Could someone please suggest the status under which I can file and the corresponding forms?

My husband entered the US since 2003, and constantly keeps the F-1 status until now. Could I file a tax return jointly with my husband? Or must I file a tax return separately?

Can I claim the $5000 deduction under the Tax Treaty between U.S. and China?

I was working in a company since January on OPT and changed to H1-B under the sponsorship of that company. If I should file 1040NR-EZ, should I only file the first 9 month salary on that form, because I was in OPT status for that period? How about the other 3 months of salary of being a H1-B holder?

Am I qualified under the dual-status filing? If so, do I need to file two different forms?

When should I file as a resident alien?
