View Full Version : Can credit card companies put a lien on my property?

I have recently retired, my husband got almost half of my nys teacher benefits from a quadro... (got nothing from him 'cause he didn't have anything) can't pay credit cards any longer... believe I am judgement proof... can a lien be put on my house... I don't have a mortgage and pay all my taxes

Generally, they can't put a lien on your personal residence for unsecured debt. Though that does vary from state to state. However, even if they do place a lien, that just means you have to pay when you sell. They can't force you to sell.

If you have any income at all, like a retirement, those funds are subject to garnishment... So, I don't know if you're so judgement proof.
