View Full Version : F1 to H1 status change OCT 1 2007, Tax filing

HI,

I have been on my OPT from jan 2007 and on OCT 1st my status changed to H1, Now I want to know what forms should I file for taxes. I have enter US in Jan 2005 so I haven't been long enough to claim as a resident.

Do I have to file 1040NR-EZ along with 8843?

And I have been withheld SSN and Medicare taxes for the whole 2007, so should I calculate and claim that amount till OCT 1st?

If I file 1040NR will I be able to claim the Tax Treaty benefit in my situation?

Form 1040NR-EZ wth Form 8843.

You are entitled to a refund of the Social Security and Medicare taxes withheld through 30 Sep 07. You will need to file Form 843 to claim that refund.
