You should file another Form 1040NR-EZ. Filing as a resident alien really does you no good because, as an Indian citzien, you can already claim the standard deduction.

However, if you paid any tuition or fees, then you might want to wait and file as a Resident Alien under the First Year Choice. You would have to wait until early June to file, but the Education Credit may make that wait worthwhile.

Yes, you have to file tax retruns with both Delaware and Georgia.

Hi all,

I am so confused, I will really appreciate if I can get some help. My situation --

F1-Graduate assistant (Georgia) Jan 1, 2005 to May 31, 2005
F1-OPT (Delaware) June 6 2005 - Oct 31 2005
H1 (Delaware) Nov1-Dec 2005
I am from India
I filled 1040NREZ for 2004

Which form should I file for fed taxes to maximize my returns? I don't have any itemized deductions except the insurance I paid while I was in F1.

And also, should I file part-resident forms for Delaware and Georgia both?

Thanks a lot for your response. So what is the difference between 1040NR and 1040NREZ? Sorry this might be a stupid question.

I understand that I have to file both in DE and GA. But I was just wondering about the resident/part resident/non resident part? Is there any test (like the no of days present in one state) to determine which category I will fall into?

The Form 1040NR-EZ is easier to fill out.

You lived in both GA and DE long enough to be a part-year resident in both states, so file as a part-year resident.

Attach a copy of one state return to the other state return so each state's tax authority knows you are paying the taxes to the appropriate state.
