Can my daughter and her child move to another state without father's consent if they are not married?

Hello nc:
Whether they're married or not has nothing to do with it. Whether he has court ordered visitation IS what matters. If they go, you go to court. That should bring them back.

We need a lot more info here. We need to know whether paternity has been established or acknowledged. We need to know if there is any court ordered custody and visitation involved. We need to know whether the father is trying to be a part of his child's life.

The marriage is not part of it. It is the issue of the court order custody agreement between the two parents. So after the birth of the child, what was the custody agreement, does it address the issue of moving out of state. What is the child support order,
Does the father visit with the child now, and so on.
So as long as the court ordered custody agreement allows them to move and/or the bio father allows it, then it will be OK.
