View Full Version : Probation ended but payments ongoing

I am a mass resident convicted of fencing in NJ. I was sentenced to 5 years supervised probation, that was transferred to Massachusetts, and a fine/restitution in the payment of 50.00 per month payable to NJ. My probation is done but my payments are not. I made a few payments to NJ since my probation ended but am substantially behind on them as of now.. can I be held in violation of probation? My probation has ended and all payments were current up until that time. Can I be in trouble in Ma? Could there possibly be a warrant for me in Ma or NJ? Someone please help my Massachusetts probation officer has released me from his supervision and had told me that my mass. Probation term is satisfied

I doubt that your probation is actually over, it may be 5 years, but normally will include or until full payment is received. So most liekly the probation remains in place until full payment is made.

If the payment was part of the court order, even if probation is eneded ( and I don't think it is) you can be found in contempt, and arrested for that, held, till you make payments arrangements that satisfy the court.

I think when you were taken off probation, your restitution went from being something they could put you in jail for not paying into something they can only sue you for if you don't pay.

In other words, it went from criminal to civil. I don't know this for a fact. Hell, I don't know anything for a fact, but if you really and truly are OFF probation, then they can't go ooops. Before you stopped paying, however, I'd make absolutely certain that your probation has ended. I wouldn't just take their word for it. I'd want something in writing.

The best thing for you to do at this point is to go or call the NJ courthouse and look at your file and see just what has been entered in your case that sys that you are either off probation or not. If you call the clerk she can read you the last entry that she finds in your file. You should also get a copy of your disposition sheet. She will tell you how much to send her in a check, where to send it and you'll get the dispo sheet and any other Orders you request. This will spell out your probation terms as the judge has sentenced you to perform and complete. If the payments are part of your probation's terms then they must be completely paid off. I can't see the PO telling you that you are off probation without having the money paid in full. In all the instances I've ever seen, the probation officially ends when the money is paid in full. Do check it out and see what's on paper before you stop paying anyting. Mass may be satisfied, but is NJ satisfied is the real question here.
