Hi, first time user, I have been divorced for over 2 years and last night at 10:30pm my daughter text messages me asking why her mother and her husband have to fight this late at night, which involved the Police showing up around 11:00-11:15pm. My daughter age 17 and son age 11 live with their mother, I do not want them in a house hold with domestic violence happening apparently kids mom hit husband, what do I do? Kids Dad

Hello, I am not an expert by any means, however I have some experience in what is happening. The best thing that I can tell you is that you just have to be there for when your kids need you. As long as the kids are not being abused there is not a lot you can do right now. Kids need you support and love, they will come to the realization that an abusive relationship will never work and will usually be drawn to the parent that shows how to love in a mature way and not one that is abusive or controlling. Sound also like the mother has some very disturbing issues if she has to turn to violence, is she a substance abuser or always been prone to violence? If so she can be declared an unfit mother and you would have to go for custody. Like I said though I am not an expert, just been through it.

Ok, she has phsycial custody, so for you to get custody, you have to file a motion with the court asking that you be given custody, the children will be allowed to say what they want. You can present copies of the police report ( if there was one, sadly many police don't do a report, since the new domestic abuse laws require either an arrest or pages and pages of paper work)
But it will all start with a trip to the attorney to start it rolling
