Hi,

I came to US on 8th Dec 2007 on l1 visa. Now for the year for 2007 I need to file income tax returns. As I do not pass substantial presence test I need to file 1040NR. Correct me If I am wrong.

As I prefer to do it myself instead of going for any tax agents. I do have few questions, I would be grateful If I can get answers for these.

1. While filling 1040NR form I didn't find a field or section where I can mention my social security tax and medicare tax withheld by my employer. My employer has already deducted and the information is available in W2, but do I need to mention it some where in 1040NR? If yes where?

2. I have been told by people that for the first time you can't do e-filing and you have to do a paper filing. Is that true?

3. For the state tax return I will have to submit form 540(NR). Right?

Thanks in Advance

1) Social Security and Medicare are NOT addressed in your annual tax return. These are FLAT taxes withheld and paid by the employer.

2) True; Forms 1040NR and 1040NR-EZ must be mailed; they CANNOT be efiled.

3) Yes, as a part-year resident of California.
