I am planning on getting married and I owe The Friend of the Court for back child support.
Question: If I keep my bank accounts separate ,SSN# will not be on her accounts, from my wife's bank accounts can the government go after money in her bank accounts because of my back child support?

Keep all bank accounts separate.

Mostly its going to depend on where you live and if your ssn is on your tax returns expect it to be intercepted. Another thing they can do is count your partners income with yours and increase any payments your currently making. Again that mostly depends on where you live etc. Best to talk to a lawyer and get answers for your area.

Califdadof3, if they file separately it may never be found out. We are talking about bank accounts. I just hope he pays his dues in child support.

I'm an accountant in Indiana so all I can say absolutely positively is for Indiana. If you keep all your accounts separate then no her accounts will not be bothered. Also with your taxes there are two ways to file to make sure she gets her full refund, first is to file "married filing separately" second is when you file a joint return she also files a damaged spouse form along with it. I do hope you can catch up on your support though.

I understand we are talking about bank accounts and I stand by what I have said. Its going to depend on where they live as to what actions can be taken against a spouse. I was just trying to give a heads up on the tax thing because that's more national ( i.e. federal ) then it is local in the U.S.
In some states the rules change when you owe back support vs regular ongoing child support. In many states a spouses income can be counted under certain conditions. Again it really all depends on where they live. Another thing is if you really want the truth then consider this.. The real answer is yes. A lot of agencies tend to do things because they think they have a right to do so in order to collect. That's where it gets sticky and knowing the local law can answer a lot and sometimes put out fires before they begin. By no means does it mean they have the absolute right to do it its just they presume they do until a court orders them to do different. I know this happens because it has occurred to me and others that I know. Im not saying its right and Im not judging this current situation this person has. Im just trying to put some things out there that may or may not have been thought of so they know what to expect and how to treat it if it comes up.

NO KIDDING> They took ALL of our tax return, garnished 60% of his wages, on top of wanting him to pay and additional amount each months. His paycheck last week was less then $200. Now he is supposed to send them an additional $650 per months. How, I have no freaking clue. As it stands, I have to pay for the children to have the required FULL medical insurance out of my tiny disability check.
Point of all this... PROCEED with caution!! The courts are very predjudice against fathers. We have been dealing with an unbelievable amount of total injustice for over 9 years now.
THERE IS NO JUSTICE FOR FATHERS... DON'T EXPECT IT.

I don't know your situation but that being said I always tell people if there are support orders in place the VERY MINUTE the financial situation changes you have got to get into Court for a revised order to protect yourself.
Not addressing you but it also helps if you're not in arrears when your financial condition worsens.
And, unfortunately, no matter what the parents' financial situation is, the kids have to eat... and wear shoes and all of that. And life is no bed of roses for the custodial parent, usually the mother, either. In many States support is by Statute and that's caused as many problems as it was supposed to solve.

I do not believe that you are protected under ANY circumstances. This country is now mostly socialist/communist in it's laws and interpretation of laws, and they can do anything that they can get away with. What they do is sign a form, fill out a request, etc. and it's done. For you to reverse it takes a LOT of time and even MORE money. I don't even owe any child supporty, and Michigan just tried to debit $136,000.00 from my checking and savings accounts. I receive $120. Per week in unemployment, (hopefully still), and at that rate I'd die before any of it was even dented, because they keep adding $1200. A month interest. These people have no conscience or sense of the law. They've taken over a hundred grand from me over the past 5 or 6 years, and I don't even owe support. This case was "created" out of thin air by a judge in Barry County Michigan that was sleeping with two of my sisters, with whom he took my now deceased mother's entire estate for themselves, even though she willed it all to me. These folks have tried 8 times to kill me. Four in Michigan, four where I now live. Three of the attemptees are now in prison.
So, no. Do not assume that one day you will try to buy groceries and find out that the paycheck you deposited, and many more thousands are now being sought by the friend of the court. They are not honest. For every dollar they collect, whether legally or otherwise, they receive matching federal funds. Their entire budgets in some jurisdictions are paid solely with the matching federal funds. With the economy destroyed, they are now much more desperate than ever, and will try even harder. Protect yourself any way you can, and good luck.
