View Full Version : Mother Indian citizen and visited US for less than 6 months can I claim her dependent

Hello there,

While reading the forum on this website, I saw you helped many people with their complicated queries about tax returns.

I would appreciate if you can respond to this query. Thanks~

My Mother came to US on May 13 2007 and left US on 6th oct 2007. She is came here on Visitor Visa and she is Indian Citizen. I paid for all her stay in US and also she is not earning any thing in India and she is NOT claimed on any tax returns in india.

Can I claim her as dependent on my 2007 tax returns.

No, you cannot.

She must be resident in the U.S. for at least 183 days to be claimed as a dependent.

There are three requirements:
1. The dependent must be a U.S. citizen or resident.
2. You must have provided more than half of the support for the year.
3. She must not earn more than $3,400 in 2007.
