My daughter got a possession charge a few years ago, and was placed on probation. She missed a court date as she was 5 months pregnant at the time and was really sick. She was residing in New Jersey @ this time, the guy she was with bailed on her and I told her to come home (PA). I had no knowledge of this charge until she realized that she can't do ANYTHING with her life until she gets this situation resolved. Where do I begin to help her? I'm pretty sure they haven't forgotten about her but she's been pulled over for traffic violations since, so why didn't a warrant or anything come up? Please help me..

Hello furbi:

So, you actually expect government to be efficient, huh? I don't – not even close.

Whether there IS or ISN'T a warrant has nothing to do with whether she's wanted in NJ. You KNOW she's wanted! If you want to help her, hire a NJ lawyer to make her return as painless as possible.

Of course, if you're thinking that she doesn't have to go back because you don't think there's a warrant, you won't be helping her at all.

excon is correct, several things, often if you are out of state and get stopped for a traffic ticket, not all police run a NCIC for the person getting the ticket. ( for many various reasons) So they may just have not checked. Second if there was, they would have merely stalled her for 10 to 15 min at the scene while they asked the other state if they wanted her held and transported, sometimes they will not pay the money to do that, so the perosn is just let go for now but that does not mean they are free.

So yes, a attorney needs to be hired in the area this happened at, and have them investigate it and arrange for any issues to be cleared up.
