I have an infraction in my criminal record (Driving w/o driver's license)
It reads: DISPO: convicted
Conviction status: infraction
Fine: $100

I wanted to expunge this, but I talked to a lawyer, and she said that infractions can not be expunged and that infractions are not criminal crimes. So she said that I can legally answer "no" to the question: Have you ever been convicted of a crime?
Is this true?
What if the employers see that I have a conviction for an infraction in my criminal record, and if I answer no to the have you ev... question, they would think that I lied. I am confused.

You've posted a variation of this question on two other threads - you got good answers then. I can't imagine that anyone who answered you then - I think less than a month ago - is going to have a different answer now. Sometimes it's your boyfriend's problem, sometimes it's yours but it seems to be the very same thing.

You have an Attorney; you got very specific advice from an Attorney who knows all the circumstances as well as your local and State laws; I would take the Attorney's advice.

This is a traffic ticket, was it issued in city court or state court ( your two choices in GA) City citations are not considered crimes. In all issues, traffic tickets are not considered a "criminal offense) also in most cases the question asks about a felony.

But you can put no, this is not considered a criminal issue as listed on employment applications, if they wish to know about driving history they will ask that separate or say including traffic offenses.

Driving offenses normally drop off checks in either 3 years or 7 years on any reports

Judy and Chuck are right. This will not show up on your record as a criminal offense. This is just essentially a ticket and nothing more. You can safely say that you were not convicted of any crime and be telling the truth.
